I guess you could argue that they stipulated to this stuff in order to tee up the pure legal claim that they have the power to do so notwithstanding the first amendment without having to litigate a factual dispute, but that would be a very weird strategy even for this DOJ...

The fires in Ontario - like so many others - demonstrating viscerally how climate change perpetuates the displacement and dispossession of Indigenous peoples, who have least contributed to emissions and over and over again put their bodies on the line to prevent fossil fuel development.
