What evidence is there that patients were referred inappropriately?
At this stage, it is not known if patients have been referred inappropriately. The purpose of the Independent Clinical Review is to assess this.

Have any patients undergone surgery inappropriately?
At this stage, the NWJCC has not identified any patients who have undergone surgery inappropriately.
However, there are cases where patients have been referred into the surgical pathway but have not gone on to have surgery, including where NHS England providers have identified that referral criteria had not been met. It is also recognised that concerns have been raised by some patients about the referral
process.
The purpose of the current review is to better understand these concerns and provide assurance that patients are being appropriately supported, assessed and referred, and that the necessary clinical governance arrangements are in place.

Does this mean patients may have come to harm?
No immediate patient safety concerns have been identified by the NWJCC, and therefore they are not concluding that patients have come to harm.
However, concerns have been raised through complaints to the NWJCC, correspondence, and other information received about the gender affirming surgery pathway. As a precautionary measure, referrals, surgical assessments, and surgery are paused while further review work is undertaken.
These prompt actions have been taken to ensure any potential risks
are identified and addressed as quickly as possible, and that patients continue to receive safe and high-quality care.

The "concern" raised is that there are more people being referred. Not a higher rate Vs patients seen. Just a higher number. Because the Welsh service sees more patients. They have taken actions with real material harm, psychological and financial, before establishing that there are real problems.

I am writing to inform you that the NHS Wales Joint Commissioning Committee (NWJCC) has placed the Cardiff and Vale University Health Board (CAVUHB) Welsh Gender Service (WGS) into Level 3 Escalation with immediate effect. The executive lead for the escalation process is Professor lolo Doull, Medical Director, NWJCC.

As part of this escalation, the following actions have been directed with immediate effect:

1. All referrals from the Welsh Gender Service for NHS England commissioned gender affirming surgery are to be paused.

2. All surgical assessments and gender affirming surgeries for Welsh Gender Service patients already referred to NHS England commissioned providers are to be paused.

3. No further surgery should proceed for Welsh Gender Service patients until the NWJCC.confirms that the pause has been lifted.

Could you please ensure that all members of your team are notified that these arrangements take effect from today (26/08/2026),

The pause will remain in place until the NWJCC is assured that appropriate clinical govemance, assessment and referral processes are in place within the Welsh Gender Service

An urgent Independent Clinical Review of patients currently on surgical waiting lists is being commissioned jointly by the NWJCC Medical Director and the CAVUHB Medical Director. In parallel, CAVUHB is establishing arrangements to communicate the pause with affected patients, and to put support in place, including a dedicated helpline.

This action has been taken following concerns arising from referral data from 25/26 indicating significantly higher rates of referral for gender affirming surgery from the Welsh Gender Service compared with English gender services. GDNRSS data showing substantially lower progression rates to masculinising genital surgery for WGS referrals compared with English gender services; and concems regarding the appropriateness of some referrals received from the Welsh Gender Service.

While we recognise the significant waiting times already experienced for surgical assessment and treatment, we feel that a temporary pause is the safest and most proportionate action pending completion of the independent Clinical Review, and until such point that we have assurance of clinical governance via CAVUHB.

I have another example of Transphobia can kill/cause serious harm Went to A&E for an infection and because I am trans and have had bottom surgery. They refused me care. Expecting me to drive 2 hours to my surgery team for URGENT care. Something that A&E should give. My GP had to step in and help me

This is not how healthcare should work.

Young people’s lives are not party policy. Clinical decisions should not be made to satisfy political “red lines”. And evidence-based healthcare should never be sacrificed to protect a politician’s ideological position.
