3A References to male and female inmates
(1) For the Act, section 79(1)(a)–(C1), the following factors may be considered in deciding whether an inmate is a male or female inmate for the purposes of this regulation—

(b) the effect of the decision on the requirements to maintain security and good order under this regulation and the Act,

Good morning. Welcome to the UK, where our equalities watchdog has a handy guide on how to hatecrime people you don’t like the look of in public toilets and the Tories are standing a Neo-Nazi local government candidate who was jailed for antisemitic harassment.
There a million things wrong with the EHRC guidance, as you all know, but for me the weirdest thing about it all is that its authors don't even seem to be aware of the possibility that someone asked to leave a "single sex" facility might refuse.
I know folks mean well however repeating the idea that "trans rights are not in opposition to women's rights" feeds subconsciously into the idea that trans women aren't really women. Trans women's right are women's rights.
The EHRC code of practice comes in today, bringing in to the UK the most draconian regime for single sex spaces targeting trans people for a liberal democracy in the industrialised, under what is our nominally left of centre governing party.
Bringing this back to EHRC commissioner @sundersays.bsky.social attention. You have a responsibility to uphold equality for all people in the UK. Your organisation is failing badly at this - in fact they are agents of inequality and oppression I hope you’ll actually try and fight this in some way

Stephenson says that it’s not on service providers to police toilets but Kirkpatrick says that service providers have the obligation to uphold the law - when Sarah Owen presses them on how those things are reconcilable they just flounder.

(There is nuance here, there is still some sort of protection against discrimination, but the logic is so torturous as to mean that trans people's rights are significantly more precarious, difficult to protect and difficult to balance than they previously were)
A court ruling in 2025 by the supreme court decided the govt couldn't have possibly meant precisely what the government said in a lot of detail when the act was originally published, an instead must have been interpreting the EA2010 as excluding trans people in most goods and services.
One day we'll have overcome their smug smiles and platitudes. Onwards!

This should be seen in its proper context. It’s long been normal for the press to treat far right crackpots and straight fascists as valuable authorities on extremism, and to present them to the public as anti-radicalisation and as antiracists. They’ve been doing it for at least ten years.

Today the most markedly hostile anti-trans regulation ever conceived in the UK goes into force - creating legal chaos and an environment of suspicion and hostility targeted at anti-trans segregation with a blast radius that will hit everyone else as well. It is unworkable, unenforceable, and cruel.
