1/ I looked at 20 years of Supreme Court decisions and found that for the first time, all nine justices decided more cases by secret ballot — aka the “shadow docket” — than it did for cases argued in open court last term. 🧵:

5–4 on a constitutional question that is older, more settled, and just as clear on the text and purpose as "can women vote?" They're coming for that one too, it's currently in the "right-wing extremists on social media" stage, same place where "there's no birthright citizenship" arose.

See, people always want to make this just about "sports," but the real upshot here is that, 6-3, trans women can't make a claim under the Equal Protection Clause. And if they can't do that, it's hard to see how they have constitutional rights.
